Definitions

In these terms:
‘Company’ or ‘Wests National Coaches’ means Wests Transport Enterprises P/L
(trading as Wests National Coaches).
‘Customer’, ‘you’ and ‘your’ means the purchaser of charter services from the company.
‘Terms and Conditions’ means these Terms and Conditions.

PRIVACY

Wests National Coaches has a privacy policy that all personal information received in the performance of our services will be treated with confidentiality by the company and its staff in accordance with the Department of Transport and Main Roads Contract requirements and School Transport Assistance Policy, unless otherwise required or authorised by law.

LIMIT OF LIABILITY

Your access and participation in this website constitutes acceptance of the terms and conditions. If you do not wish to abide by this, please do not use the site. Wests National Coaches accepts no liability resulting from the use of this website. The content of this site is for informational purposes only, Wests National Coaches are not responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via the site and is not responsible or liable for any errors or omissions in that information. Your booking of any coach trip with the company is accepted subject to the terms and conditions here and by confirming your booking you accept that these terms and conditions will apply. The company has no liability for any act, omission, default, whether negligent or otherwise of any third party. We have no liability for any loss or damage occasioned by the negligent act or omission of any third party. In situation where liability cannot be excluded, liability is limited to the full value of the charter cost.

MODIFICATIONS

Wests National Coaches is free to change the terms and conditions at any time without prior notice and these will be effective immediately, binding on the customer and any changes will be updated on the website as soon as practicable.

PAYMENT TERMS

Our payment terms are 7 days from receipt of invoice unless payment is stated as required prior to date of charter. In this situation, payment must be made no less than 24 hrs prior to date of charter in order for payment to show at bank. If payment is not received within the required time frame, a late payment fee may be levied, at the company’s discretion.

CREDIT CARD ACCEPTANCE AND CHARGE

Wests National Coaches currently do not have the facility to accept credit card payments, should we do so at a later date, you will be notified on invoice/at time of payment of any applicable surcharge.

QUOTATION

All prices quoted by Wests National Coaches are current at time of quote and are subject to availability at time of booking. All quoted prices include GST and are to be paid to the company in $AUD. We do not pay commissions on any quoted price unless prior approval is given. All prices, unless prior approval given, are to be given in writing by email, fax or post. Verbal quotes will not be considered binding as authenticity cannot be guaranteed. Wests National Coaches reserves the right to pass on to the customer, without notice, any increase in cost, in relation to your charter, that may occur, including but not limited to airport pickup fees, tolls, parking charges.

BOOKING CHANGES

A change to a booking is any detail that is different than what was quoted on and accepted at time of booking, including but not limited to, change of date, time, destination, bus size, addition or ommission of any detail.Any change to a booking can only be accepted subject to availability. The company reserves the right to charge an amendment fee in respect of any change to your booking in addition to any applicable charge in relation to that change. You are responsible for any charge levied by any third party supplier in respect of extra time in the event that your booking does not run to scheduled/booked time.This includes any extra charges where you choose to extend the time of your booking, including but not limited to charges for flight and/or traffic delays.

BOOKING CONFIRMATIONS

Charters booked with Wests National Coaches are considered fully confirmed, ONLY when you have received a written confirmation by email/fax that is signed/named by yourself and signed by a company staff member stating all details of booking.
PLEASE NOTE: Receipt of your School/Company issued purchase order DOES NOT constitute a confirmed booking until a booking confirmation as above has been received by you from Wests National Coaches.

UNFORESEEN CHARGE

Wests National Coaches charters are priced on time, distance, vehicle size and availability. Accordingly, any variance to the above will incur extra charge to charter cost. It is NOT the responsibility of Wests National Coaches or any of its staff/driver to warn you of any impending charges that may occur including but not limited to, overtime, damage or extra distance travelled regardless of the circumstances on the day of your charter. It is the responsibility of the customer to make themselves aware of any possible extra charges that may be incurred.

CANCELLATIONS

Wests National Coaches understands that circumstances can change quickly and we will do our very best to accommodate these changes, where possible. Should you require to cancel your booking, cancellation requests sent to us ( email/fax) must be acknowledged by the company,in writing, via a reply email/fax confirming the cancellation.Wests National Coaches accepts no responsibility for cancellation requests made via phone, phone message, or email that are not confirmed by a cancellation acknowledgement and any and all costs associated with the failure to give proper cancellation notice will be payable by you. Wests National Coaches reserves the right, at the discretion of the company, to charge a cancellation fee as follows:

Above charges are subject to alteration, without prior notice, if the company believes it is warranted and fair consideration has not been given by you regarding the cancellation. In the event that a charter booking requires the hiring of any third party suppliers and this is made known to you at time of booking, you acknowledge that should you cancel your booking you will be liable for payment of any charges levied by any third party supplier in respect of your booking however any and all charge will not exceed charter cost.

REFUND POLICY

Wests National Coaches will, at its discretion, provide a full/part refund of any charter payment made to the customer in the event that the booked charter was unable to go ahead and provided that sufficient and correct notice was given as stated in the cancellation terms. Wests National Coaches reserves the right to deduct a reasonable administration fee from the refunded charter payment, to any charter cancelled for any reason, even when cancelled in adherence to correct cancellation terms. Refund payment will be made, unless specifically requested, in the manner deemed most appropriate by the company which in most cases will be the manner in which it was paid to us.

FOOD AND BEVERAGE

The consumption of food and beverage is NOT permitted on any Wests National Coaches vehicle at any time unless prior approval has been given. In such circumstances, the company may require the payment of a refundable bond to cover any risk of damage to vehicle or any property of the company. No Alcohol ( opened or unopened) or glass products are allowed in cabin of any Wests National Coaches vehicle at any time. Food and beverage( sealed containers) of any kind, may be transported in an appropriate vessel ( eg esky) in coach luggage bins on request.

BAGGAGE

Wests National Coaches reserves the right to refuse carriage of any luggage deemed unsafe or unacceptable or that cannot be carried without undue risk of damage to the item. Any oversized items must be declared at time of booking or no guarantee of carriage is given. Oversized items include but are not limited to surfboards, bicycles, golf buggies, army packs, marquees, drum kits.

DAMAGE

You will be responsible for any charge levied by the company in respect of any damage caused to the vehicle or any property of the company, whether caused direcetly or indirectly by yourself or any persons directly involved with you.

REFUNDABLE BOND

Wests National Coaches reserves the right, at their discretion to charge a refundable bond for any charter group at any time, to be paid in addition to charter cost prior to date of charter to cover for any issue, including but not limited to damages to vehicle or property, late return, no show, extra cleaning required, or unacceptable circumstances on trip. In particular this may be applied to a charter that pickups/terminates on/after 12.00am. The bond paid, will be held by the company and returned in full to the customer at the next available opportunity on completion of the trip in the event that none of the aforementioned has occurred. Should any of the aforementioned have occurred, Wests National Coaches will levy a portion or full amount of the bond, at their discretion, to cover expenses inccurred in respect of such damage.

REFUSED TRAVEL

Please Note: Wests National Coaches and/or its drivers as representatives of the company reserve the right at any time in the journey to refuse travel on the coach to any persons or group that is unacceptably intoxicated and/or behaving in an abusive and/or threatening manner if it is deemed that their continued travel will pose a safety risk to themselves, the driver and/or other passengers even if they are a member of the hiring party or in any way involved with the hiring party. Wests National Coaches will not accept any claim by the excluded party and/or any companions/passengers that choose to cease travel with the excluded party for part or full refund/compensation/payment of alternative arrangements of any kind in the aforementioned circumstances.

SMOKING

Smoking is NOT PERMITTED, by law, on any vehicle supplied by Wests National Coaches at any time.

AIRPORTS

When you have an airport pickup charter booked with Wests National Coaches, whether domestic or international, unless stated otherwise, your booking will allow 30 mins waiting time after original scheduled flight arrival time. Any time beyond this may incur extra charge for driver waiting time.

DELAYS

If there are extensive delays to departure times on a booked charter, the company cannot guarantee that it will be able to fulfil the booking if vehicles are committed to other charters or school service runs. Quotes are based on the understanding that they will proceed with normal times and without undue delay beyond our control, including but not limited to weather, act of God, passenger injury or traffic accident. Sometimes these unforeseeable delays incur significant cost above and beyond the booked charter cost. Wests National Coaches cannot feasibly allow for these possible costs into our quotes but will make best effort to advise you of the possibility of these as soon as we are aware of them. Delays/diversions and any decisions in the respect of the above will be at the sole discretion of the company and as not allowed for in quoted charter costs will be therefore payable by you at the appropriate rate.

ALTERATION

While every care is taken, Wests National Coaches reserves the right to alter or refund any charter booking at any time it may be required, without notice or liability accepted, especially if circumstances occur outside of the company’s control, including but not limited to, weather, vehicle breakdown or driver unavailability. The company accepts no responsibility for delay or termination of charter as a result of circumstances out of the company’s control. Any route, pickup, drop off or destination stated as part of charter booking is subject to suitable accessibility to/via the stated location for the vehicle used. If this cannot be safely accessed without risk of damage to vehicle or property or risk of injury to driver and/or passenger, as determined by the company and/or driver, Wests National Coaches and/or its driver will, where possible, advise the nearest possible pickup/drop off location.

WAIVER OF BREACH

No failure by the company to insist on strict performance of any of these terms and conditions constitutes a waiver of any right to which the company may have in respect to any other portion of the terms and conditions and is not a waiver of any subsequent breach of the terms and conditions by the customer or any subsequent action thereof.

SUB CONTRACT

Wests National Coaches reserves the right to sub contract another licenced operator/vehicle of appropriate type/size and cross hire vehicle operator/staff without prior notice.

LOSS OR INJURY

Whilst all due care is taken, Wests National Coaches accepts no liability for death or injury to any person directly/indirectly involved with a booking whilst travelling, boarding/disembarking vehicle, in so far as the death or injury was not caused by the negligence of the company. Whilst all due care is taken, Wests National Coaches accepts no liability for loss or damage to any property of any person directly/indirectly involved with a booking whilst travelling, boarding/disembarking vehicle.

TESTIMONIALS

By sending any feedback/testimonial/information to the company by phone/email/fax in relation to your charter booking you grant the company an unrestricted, irrevocable licence to use, display, transmit and distribute that information for the purposes of company improvement however, in accordance with our privacy policy, Wests National Coaches will not release any personal/directly identifying details unless permission is granted by you, we first notify you that they will be used/published or are required by law to do so.

Except as specifically permitted herein, no portion of the information on this website may be reproduced in any form or by any means without the prior written permission from Wests National Coaches.
